The immediate effect of filing bankruptcy.
Once someone files a bankruptcy petition, a bankruptcy estate is created, which consists of all property (of any kind), money, and claims to property or money, which the filer may hold. The automatic stay which is immediate upon filing of the bankruptcy petition prohibits any action by anyone to obtain property or money from the estate, or to create or perfect any interest or claim to property or money of the estate.
We take emergency cases. If your home is about to be foreclosed, your car repossessed or your wages garnished, it may be important to file your bankruptcy case right away. Unlike many other firms, we will not turn you down if your case is an emergency and we can file your case quickly, sometimes the next day. Cost
Your fees will depend on the complexity of your case, but the simplest Chapter 7 cases can be filed for $1500 or less, including court costs. More complicated cases, such as a Chapter 13, may cost several times as much and a Chapter 11 case (often used to restructure a viable business) can cost upwards of $10,000. No matter what your situation though, you will find that our rates are often lower than most other bankruptcy firms in the valley.
We completely understand that if you had that kind of cash, maybe you wouldn’t need bankruptcy. Please do not let that stop you from considering all of your legal options. There are many ways to pay fees, including through a payment plan. A Chapter 13 can be filed for less than $300 up front.
